Terms of Service

Welcome to FastFlowUp. These Terms of Service ("Terms") govern your use of all services, platforms and websites operated by FastFlowUp Pty Ltd (ABN 14 677 767 458), registered in Australia with operations in Bangladesh (BD Reg: C-196991/2024). By accessing or using our services, you agree to be bound by these Terms.

"FastFlowUp", "we", "us" and "our" refer to FastFlowUp Pty Ltd and its subsidiaries. "Client", "you" and "your" refer to the individual or entity accessing our services.

Services

FastFlowUp provides technology, marketing and education services through four divisions:

  • Products & Engineering: Custom software development, web and mobile applications, cloud infrastructure, AI and automation, cybersecurity, DevOps, UI/UX design, API development, HRM and payroll systems, and virtual assistant services.
  • Brand & Marketing: Brand strategy and identity, content creation, creative design and video, campaign activation, lead generation, SEO and performance marketing.
  • Flowy Platform: AI-powered exam preparation for PTE, IELTS and GRE, including native AI scoring, adaptive learning paths and live expert sessions.
  • Streetwear & Lifestyle: Physical apparel sold under the False Youth label, including chip-enabled streetwear, limited drops, FY Club membership and the wearer profile pages linked to each garment.

Individual products including but not limited to Flowy, Orbits, anzsco.ai, eml.ninja and DocSuite.app may have additional terms specific to their use. In case of conflict, product-specific terms take precedence over these general Terms.

Account Registration

Some services require account registration. You agree to provide accurate, current and complete information and to keep your account credentials secure. You are responsible for all activity under your account.

Payment Terms

Clients are responsible for paying all fees associated with services ordered through FastFlowUp. Payments are processed through Stripe or local payment service providers as applicable. FastFlowUp does not store client payment card information; all payment data is securely handled by the respective payment processor.

For project-based services, payment schedules will be agreed upon in the project proposal or statement of work. Invoices are due within 14 days of issue unless otherwise agreed in writing.

Intellectual Property

FastFlowUp retains all right, title and interest in its platforms, tools, methodologies, frameworks and proprietary technology. For custom development projects, intellectual property ownership transfers to the client upon full payment unless otherwise specified in the project agreement.

Content, trademarks, logos and branding elements of FastFlowUp and its products remain the exclusive property of FastFlowUp Pty Ltd.

Client Obligations

You agree not to use our services for any unlawful purpose, to interfere with the operation of our platforms, to attempt unauthorized access to our systems, or to infringe on the intellectual property rights of FastFlowUp or any third party.

Limitation of Liability

To the maximum extent permitted by applicable law, FastFlowUp shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from or related to your use of our services. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim in the 12 months preceding the event.

Indemnification

You agree to indemnify and hold FastFlowUp harmless from any claims, losses, damages, liabilities and expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

Termination

FastFlowUp may suspend or terminate your access to services at any time for violation of these Terms or for any other reason at our discretion. For ongoing service agreements, either party may terminate with 30 days written notice unless otherwise specified in the service agreement.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any dispute arising from these Terms shall first be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to the courts of Victoria, Australia.

For clients engaging services through our Bangladesh operations, local consumer protection laws may also apply where mandated.

Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through a notice on our website. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
